Ky. man sues B.J.A. Trucking for unsafe working environment

WAYNE -- An Olive Hill, Ky., man is suing B.J.A. Trucking after he claims he was placed in an unsafe working environment.

James Riggs was an employee at B.J.A. Trucking as a coal truck driver and on Sept. 21, 2009, was performing his duties when he was instructed to work in an unsafe working environment, according to a complaint filed Dec. 13 in Wayne Circuit Court.

Riggs claims the defendant knowingly allowed him to work in an unsafe working condition.

The defendant knew of the high degree of risk and strong probability of serious injury or death presented by the unsafe working condition, according to the suit.

Riggs claims he suffered serious injuries from the unsafe working condition.

He is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Kenneth P. Hicks

The case has been assigned to Circuit Judge James H. Young.
