HUNTINGTON -- A Georgia woman is suing Tri-State Transit Authority for injuries her mother sustained when attempting to board a bus.
On Dec. 29, 3008, Prinnice W. Simpson was attempting to board a bus in Huntington that was owned and operated by TTA, according to a complaint filed Dec. 27 in Cabell Circuit Court.
Tiwanna Simpson claims when her mother attempted to board, the bus failed to lower for her to board, causing her to fall and fracture her arm in two places.
The defendant failed to operate the bus in a safe manner and failed to maintain the bus in proper working order, according to the suit.
Tiwanna Simpson claims TTA operated and maintained the bus "negligently, carelessly, willfully, wantonly, recklessly and maliciously in breach of the applicable standard of care."
Tiwanna Simpson is seeking compensatory and punitive damages with pre-judgment interest. She is being represented by J. Patrick L. Stephens and Mark F. Underwood.
The case has been assigned to Circuit Judge David M. Pancake.
