Raymond and Barbara Hinerman v Richard and Rita Rodriguez

* The Hinermans, in an attempt to purchase a home owned by the Rodriguezes, claim that on Dec. 21, prior to closing they were advised a water leak was discovered in one of the rooms in the house. This room was unable to be inspected because the realtor claimed it was full of children's toys and the door would not open. When they were ready to close, the sellers claimed they would not sell until the Hinermans signed documentation accepting responsibility for the leak, for which the Hinermans refused. The closing was continued by the Rodriguezes until sometime prior to Dec. 31. The Hinermans contended the leak under the purchase agreement,was the Rodriguezes responsibility and they intended to proceed with the closing. The Rodriguezes refused to proceed with the sale. The Hinermans also became aware of another buyer who was willing to pay more than the contracted price of the property. In addition, representations were made that the purchaser of this property would be given a Four Winds boat. After signing the purchasing agreement, the Rodriguezes advised the boat would cost $40,000. The Hinermans' seek compensatory and punitive damages, resolution of the issue for the leak, and a determination of whether or not an oral agreement to convey the Four Winds boat was violated, attorney fees and court costs.
