Putnam man sues Novartis for failure to timely pay wages

CHARLESTON -- A Putnam County man and former Novartis Pharmaceuticals employee is suing the company after he claims it violated the West Virginia Wage Payment and Collection Act.

Timothy Atchison was employed by the pharmaceutical corporation from May 23, 2008, until Sept. 24, 2010, according to a complaint filed Dec. 14 in Kanawha Circuit Court.

Atchison claims the defendant failed to pay his employment wages due at least once in every two weeks as required by law and also failed to pay his final wages within 72 hours.

The defendant only paid Atchison one time per month, according to the suit.

Atchison is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess.

The case has been assigned to Circuit Judge Carrie Webster.
