HUNTINGTON -- SWVA is suing St. Mary's Medical Center after it claims the hospital has failed to test blood samples of one of its employees.
The employee, W. Kevin Black, was also named as a defendant in the suit.
On Dec. 29, Black reported to work at SWVA, but within an hour of reporting to work, he passed out and fell face down on the floor of the plant, according to a complaint filed Dec. 30 in Cabell Circuit Court.
SWVA claims Black was injured in the fall and that St. Mary's took blood samples from him and has kept them to test of drug and alcohol in his system.
St. Mary's agreed to test the blood samples, but has yet to do so and due to rapid deterioration of blood samples, SWVA wants it done immediately, according to the suit.
SWVA is seeking for the hospital to test the blood samples. It is being represented by Anders W. Lindberg and H. Toney Stroud.
The case has been assigned to Circuit Judge David M. Pancake.
