Charleston woman sues Old Colony Realtors for negligence

CHARLESTON – A Charleston woman is suing Old Colony Realtors Company after she claims a real estate agent knew about problems in a house she purchased, but failed to tell them to her.

The real estate agent, Kimberly Brown, was also named as a defendant in the suit.

On May 18, Edith Chatfield contracted with Allen and Jane Fouty to buy a home for $214,900, in which the defendants were the buying and selling broker, according to a complaint filed Jan. 10 in Kanawha Circuit Court.

Chatfield claims Brown represented to her that the home had no known problems, when it in fact did.

After the sale of the home, Chatfield noticed the home's basement flooded due to outside water penetration, which caused permanent damages to the home, according to the suit.

Chatfield claims the defendants owed a duty to her to disclose all known information about the home and were negligent in doing so.

Chatfield is seeking compensatory and punitive damages. She is being represented by S. Brooks West II.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
