Cabell man sues Southern Home Care Services for failure to pay wages

CHARLESTON -- A Cabell County man is suing Southern Home Care Services after he claims it failed to pay him wages earned.

Justin Marks was employed by Southern Home Care Services, according to a complaint filed Jan. 3 in Kanawha Circuit Court.

Marks claims the defendant's actions violated the West Virginia Wage Payment and Collection Act.

The defendant actively and/or constructively engaged in a fraudulent scheme to deprive Marks of timely payment of contractual employment wages and benefits, according to the suit.

Marks is seeking compensatory and punitive damages with pre-judgment interest. He is being represented by D. Adrian Hoosier II.

The case has been assigned to Circuit Judge Jennifer Bailey.
