Former employee sues 84 Lumber for wrongful termination

HUNTINGTON – A former employee is suing 84 Lumber after he claims his employment was wrongfully terminated.

On Aug. 23, 2008, Kevin Waugh was injured during the course of his employment and filed a Workers' Compensation claim and received temporary total disability benefits, according to a complaint filed Jan. 18 in Cabell Circuit Court.

On Jan. 15, 2009, Waugh received a letter from 84 Lumber stating that his employment had been terminated, according to the suit.

Waugh claims he was terminated from his employment due to his Workers' Compensation claim and related injury and not because of any legitimate, nondiscriminatory reason.

The defendant violated the West Virginia Human Rights Act by terminating Waugh's employment, according to the suit.

Waugh is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Samuel F. Hanna.

The case has been assigned to Circuit Judge F. Jane Hustead.
