Cyphert was hired by Interim HealthCare as an LPN. As a condition of her employment, she signed an agreement that stated she could not provide nursing, therapy, home health aide or attendant services to any former client of Interim HealthCare. Cyphert was terminated from her employment in October 2010 due to her unavailability to work. Within a year of her termination, she provided services for a client of Interim HealthCare. Interim HealthCare seeks liquidated damages in the amount of $10,000 for each former client, a constructive trust on monies earned by Cyphert during the year following her termination; compensatory damages, pre and post judgment interest.

David L. McKain vs. Rodney Pyles, assessor

* McKain claims Pyles, as assessor of Monongalia County, failed to repond to a FOIA request dealing with appraisal practices of residential property for 2011. Pyles claimed that information was not available under FOI and to contact the State Tax Department for any information he wanted. The State Tax Office advised appraisal records were not protected unless it contained specific taxpayer information that would fall under a protected information section of the statute. When Pyles responded to the FOI request, he stated McKain's requests were protected and did not comply with the request. In addition to obtaining the records he requests, McKain seeks declaratory or injunctive relief asking Pyles to authorize the Tax Department to provide the requested information. He also asks that court proceedings be initiated against Pyles for violating state code provisions.
