Huntington couple sues McCloud Construction for breach of contract

WAYNE -- A Huntington couple is suing McCloud Construction Company after they claim it breached its contract with them.

Larry McCloud, an employee of McCloud Construction Company, was also named as a defendant in the suit.

On Jan. 21, 2010, Stephanie King and Geoffrey King entered into a contract with the defendants for the construction of a new house in the amount of $115,000, according to a complaint filed Jan. 4 in Wayne Circuit Court.

On Jan. 26, 2010, the Kings claim they also entered into a contract with the defendants for the purchase of real property on which the house was to be built in the amount of $20,000.

The defendants had until May 31, 2010, to complete the construction, according to the suit, and the Kings substantially performed under the contract by paying the defendants a total of $105,000.

The Kings claim the rest of the money was to be paid upon completion of the house, but the defendants have yet to complete the project.

The defendants breached their contracts with the Kings and failed to honor their obligations pursuant to the contracts, according to the suit.

The Kings are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Michael S. Bailey.

The case has been assigned to Circuit Judge Darrell Pratt.
