CHARLESTON -- An Ohio woman is suing Taco Bell after she claims she was discriminated against because of her age.
Shawn Kidd, a management employee of Taco Bell, was also named as a defendant in the suit.
Kimberly Simmons was employed by the defendant for approximately 30 years and claims she consistently performed her duties in a satisfactory manner and met the defendant's reasonable expectations, according to a complaint filed Jan. 28 in Kanawha Circuit Court.
On July 21, 2010, Simmons claims her employment was terminated because of her age, which violates the West Virginia Human Rights Act.
The defendants' actions were willful, wanton and/or undertaken with reckless disregard and/or reckless indifference to Simmons' rights, according to the suit.
Simmons is seeking compensatory and punitive damages with pre-judgment interest. She is being represented by Michael W. Carey, David R. Pogue and Mark A. Atkinson.
The case has been assigned to Circuit Judge Tod J. Kaufman.
