CHARLESTON -- Two Marmet couples are suing Mike Enyart & Sons and Miss Utility of West Virginia after they claim they suffered property damages.
In March 2010, Enyart & Sons was engaged in busting and removing asphalt on the roadway on 87th Street in Marmet near the homes of David and Terri Bray and Amanda and Clayton Cottrell, according to two complaints filed Feb. 10 in Kanawha Circuit Court.
The couples claim soon after, they began to experience cracks and other problems to their homes that had not previously been there.
The defendants were negligent in construction, engineering and mapping methods in the removal of the asphalt, according to the suits.
The couples are seeking compensatory damages with pre- and post-judgment interest. They are being represented by G. Patrick Jacobs.
The Brays' case has been assigned to Circuit Judge Louis Bloom. The Cottrells' case has been assigned to Circuit Judge Paul Zakaib Jr.
