CHARLESTON -- A Charleston man is using American Electric Power Company after he claims he was injured when he fell into a hole.
B&L Utility Contractors and Charleston Urban Renewal Authority were also named as defendants in the suit.
On March 18, 2009, Walter Colon was walking down Bigley Avenue in Charleston when he stepped on an electrical box cover that broke and caused his foot to fall down into a hole, according to a complaint filed Feb. 23 in Kanawha Circuit Court.
Colon claims in November 2001, Charleston Urban Renewal Authority contracted with AEP to complete the Bigley Avenue Gateway Project. He claims AEP then contracted with B&L Utility Contractors for the project, which was to relocate AEP's lighting along the avenue.
The electrical box cover that Colon stepped on was installed by the defendants, according to the suit.
Colon is seeking compensatory damages. He is being represented by Michael L. Glasser.
The case has been assigned to Circuit Judge Charles E. King.
