The principal sum of $70,000 was due with annual installments of $8,491 payable on each successive anniversary date until fully paid. * In the Underlying Complaint (Civil Action No. 10-C-329), Charles J. Ashby, Jr. alleged that he "was at all times hereto an employee of the defendant, Hani A. Shami and Denise S. Shami." He further alleged that he was employed for the purpose of scraping and painting the exterior of the apartment building owned by the defendants on N. Front Street, Wheeling. He suffered a work related injury on May 21, 2009, when he "lost his balance and fell 15 feet from the ladder onto a concrete block wall, and then fell from the wall onto the ground. Ashby is pursuing a deliberate intent claim against Hani and Denise Shami.

* Plaintiffs jointly owned property in Wheeling including a garage. In February 2010, snowfall caused damage to the garage and some of its contents. In an investigation of the claim for the defendant, a purported professional engineer said inadequate design, construction, age and time (not snow) were the cause. Defendant denied plaintiff's claim by a letter dated March 9, 2010. Plaintiffs pray for judgment against defendant reflecting breach of contract damages and all other associated relief.
