HUNTINGTON -- A Martin County, Ky., woman is suing Ponderosa after she claims she sustained injuries at its Huntington location.
Bruce Wooten, president of B&A Foods, which is d/b/a Ponderosa Steakhouse; and Winston Monroe were also named as defendants in the suit.
On Aug. 8, 2010, Patsy Moore walked from the Ponderosa parking lot to the handicap ramp to go into the restaurant when she tripped on the edge of the ramp and fell, severely cutting her left hand, according to a complaint filed March 2 in Cabell Circuit Court.
Moore claims an employee at the restaurant instructed her to go to the Med Express located next door to the restaurant and that Ponderosa would pay for her medical expenses, to which she complied.
The defendants have since refused to pay for Moore's care, according to the suit.
Moore claims as a result of the defendants failure to exercise reasonable and due care in maintaining its property in a reasonably safe condition, she suffered extensive and permanent physical injury and has incurred extensive costs and expenses associated with medical services.
Moore is seeking compensatory damages. She is being represented by Henry E. Wood III.
The case has been assigned to Circuit Judge F. Jane Hustead.
