Oak Hill couple says Mazda was defective

CHARLESTON -- An Oak Hill couple is suing Mazda Motor of America after they claim a vehicle they purchased was defective.

On Sept. 9, 2009, Pamela Sydnor and Philip Sydnor purchased a new 2010 Mazda Speed 3 from the defendant for $23,945, according to a complaint filed March 4 in Kanawha Circuit Court.

The Sydnors claim after the purchase of the vehicle, they experienced repeated non-conformities that they considered to be life threatening.

After a reasonable number of attempts, the manufacturer did not conform the vehicle to its warranty, nor replace it with a comparable new vehicle that did, according to the suit.

The Sydnors are seeking revocation of acceptance and refund of the purchase price; damages for repair costs; and damages for loss of use, annoyance and inconvenience. They are being represented by Anthony M. Salvatore.

The case has been assigned to Circuit Judge Carrie Webster.
