CHARLESTON -- A mother and daughter are suing Timberline Four Seasons Resort for injuries sustained from an attack outside of Timbers Pub.
Timberline Four Seasons Resort Management Co. Inc. and Shawn Foster, the man who attacked one of the plaintiffs, were also named as defendants in the suit.
On Feb. 26, 2009, Robyn Hickman was on the premises of Timberline Four Seasons Resort in Timbers Pub with Foster, according to a complaint filed Feb. 25 in Kanawha Circuit Court.
Hickman claims Foster was served alcohol for several hours and was intoxicated. She claims while standing on the deck of the premises, just outside the pub's entrance, Foster began to brutally beat her.
The defendants failed to provide bouncers or any other security to aid Hickman, according to the suit.
Hickman claims the beating continued as Foster dragged her by her hair down the steps of the pub and into the parking lot.
Foster then went back inside Timbers Pub "where he assaulted another individual and was finally restrained by patrons of the pub," according to the suit. Hickman was taken from the parking lot via ambulance to meet the helicopter that flew her to Ruby Memorial Hospital in Morgantown.
Hickman claims the defendants negligently, willfully, intentionally and wantonly served Foster alcohol.
Hickman's daughter, Cami Hickman had to quit school in order to assist in providing care for her mother, according to the suit.
The women are seeking compensatory damages. They are being represented by Shannon M. Bland.
The case has been assigned to Circuit Judge Charles E. King.
