Couple sues Charleston after falling down Municipal Auditorium stairs

CHARLESTON -- A Kanawha County woman and her husband are suing the City of Charleston after she fell down a flight of stairs at the Municipal Auditorium.

On March 22, 2009, Lucie A. Mellert was attending an event at the Municipal Auditorium and was walking down the balcony stairs when she fell, according to a complaint filed March 16 in Kanawha Circuit Court.

Mellert claims the balcony stairs were a hazard because they did not have proper handrails or lighting that would have allowed her to avoid falling.

The City of Charleston's negligence to maintain a safe area for its customers caused Mellert injuries, according to the suit.

Mellert claims the defendant had a duty of reasonable care to protect her from dangerous conditions existing on its premises.

Mellert and her husband, William J. Mellert, are seeking compensatory damages. They are being represented by Shawn R. Romano.

The case has been assigned to Circuit Judge James C. Stucky.
