Man says nursing home neglected grandmother

CHARLESTON -- A Kanawha County man is suing Harrell Memorial Nursing Home after he claims it neglected to care for his grandmother.

Nursing Care Management of America, Inc.; Judy Hash; HR of Charleston, Inc., d/b/a Oak Ridge Center; and Genesis Healthcare Corporation were also named as defendants in the suit.

Raylene Evans was a nursing home resident of the defendants from Jan. 15, 2009, until Nov. 12, 2009, according to a complaint filed March 15 in Kanawha Circuit Court.

Clay Myers, Evans' grandson, claims the defendants were negligent and careless in their treatment of his grandmother, causing Evans serious injuries.

The defendants failed to keep Evans and her family members informed of her total health status; failed to provide sufficient staff to provide adequate and appropriate nursing care; failed to provide healthcare services in compliance with state and federal law; failed to care for Evans in a manner free of hazards; and failed to provide adequate supervision, according to the suit.

Myers is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
