CHARLESTON -- A Kanawha County woman is suing Excel Resources, LLC, and two individuals after she claims they trespassed on her property and caused damage to it.
Jacqueline Smith owns property in the Cabin Creek District, according to a complaint filed March 21 in Kanawha Circuit Court.
Smith claims Carolyn S. Light is the owner of property adjacent on the waters of Cabin Creek District to Smith's property. She claims Light has permitted Rick Howell and Excel Resources to trespass outside of the specified boundary of Light's property and onto Smith's property.
The defendants have damaged trees and shrubbery on Smith's property in the approximate amount of $3,000, according to the suit.
Smith claims the defendants also excavated upon the right of way of her property, have removed gravel material and have hindered the access to and from her property.
The defendant also unlawfully removed a camper trailer from Smith's property and removed survey stakes from the driveway, according to the suit.
Smith is seeking compensatory and punitive damages. She is being represented by Walton S. Shepherd III.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
