Clarksburg couple names 56 companies in asbestos suit

CHARLESTON -- A Clarksburg couple is suing 56 companies after they claim they are responsible for asbestos exposure.

Lendell C. Simmons was diagnosed with lung cancer on Feb. 21, according to a complaint filed March 29 in Kanawha Circuit Court.

Simmons and his wife, Patricia Simmons, claim the defendants exposed him to asbestos and asbestos fibers, which caused his lung cancer.

The defendants are being sued upon theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

The Simmons' are seeking a jury trial to resolve all issues involved. They are being represented by Victoria Antion and Lawrence J. Tweel.

The case has been assigned to a visiting judge.
