Marshall Co. couple accuses WVU Board of Governors, others of negligence

MORGANTOWN – A Marshall County couple is suing West Virginia University Board of Governors, West Virginia University Hospitals and West Virginia University Medical Corporation after they claim they were negligent and caused injuries.

On Jan. 27, 2009, Victoria Flowers was admitted to Ruby Memorial Hospital as a patient and after tests and procedures were performed, she developed severe pain, numbness, swelling and problems with her right hand due to an ischemic nerve injury, according to a complaint filed April 28 in Monongalia Circuit Court.

Flowers claims that after subsequent medical consultations, she was informed that permanent damage was done to the right medial and ulna nerves of the right hand and arm, which meant she would experience pain, numbness and weakness permanently.

The defendants negligently failed to fully advise and inform her of the nature and extent of the tests and procedures performed and the risk and hazards associated with them, according to the suit.

Flowers claims the defendants failed to exercise the proper degree of care, skill and learning required and expected.

Flowers and her husband, Brent Flowers, are seeking compensatory damages. They are being represented by Wesley W. Metheney and C. Richard Wilson.
