State Department of Agriculture sues Jefferson County Development Authority over grant money

CHARLESTON -- The West Virginia Department of Agriculture is suing the Jefferson County Development Authority over $50,000 in grant money.

On April 27, 2009, the Jefferson County Development Authority entered into a West Virginia Farmer's Market Matching Fund Grant Program contract with the West Virginia Department of Agriculture, according to a complaint filed April 7 in Kanawha Circuit Court.

The West Virginia Department of Agriculture claims it advanced the sum of $50,000 to the defendant in order for it to develop the Farmer's Market.

The contractual agreement required the defendant to provide matching funds equal to the amount of the initial $50,000 grant provided by the Department of Agriculture, according to the suit.

The Department of Agriculture claims the defendant never collected or obtained matching grant funds.

In violation of the contractual agreement, the Jefferson County Development Authority spent all or a substantial portion of the grant money the Department of Agriculture provided without obtaining matching grant funds and the project failed, according to the suit.

The Department claims the defendant's failure to obtain matching grant funds and spending the grant funds provided to it without obtaining matching grant funds was a direct violation of the agreement.

The West Virginia Department of Agriculture is seeking judgment in the amount of $50,000 with pre-judgment interest. It is being represented by Arden J. Curry II.

The case has been assigned to Circuit Judge Charles E. King.
