Elkview couple sues Charleston Town Center for injuries

CHARLESTON -- An Elkview couple is suing Charleston Town Center for injuries that occurred in the mall parking garage.

Charleston Town Center Garage, Inc.; Charleston Town Center Parking Limited Partnership; and Network Parking Company, Ltd., were also named as defendants in the suit.

On July 7, 2010, Cynthia Kittle entered the Lee Street parking garage at the Charleston Town Center and parked her car in the metered parking area to the left of the mall entrance, according to a complaint filed April 12 in Kanawha Circuit Court.

Kittle claims when she exited her vehicle, her foot became ensnared in a dark line of cable that was lying directly on the concrete ledge and caused her to fall.

As she fell forward, Kittle fell onto her right knee and hand and immediately felt intense pain in the knee and ankle, according to the suit.

Kittle claims she managed to return to her car and promptly drove herself to her place of employment, where she called her husband and the Charleston Town Center Mall to report the incident.

After being transported to the emergency department of St. Francis Hospital, Kittle was diagnosed with have suffered from a right distal fibular fracture, according to the suit.

Kittle claims the defendants had a duty to provide a safe environment and failed to do so.

The defendants were negligent in causing Kittle to suffer serious physical injury and pain, according to the suit.

Kittle and her husband, Kenneth Kittle, are seeking compensatory and punitive damages. They are being represented by Bernard E. Layne III.

The case has been assigned to Circuit Judge Charles E. King.
