Company sues M.J. Zones for breach of commercial lease

HUNTINGTON -- A Cabell County company is suing M.J. Zones, LLC, after it claims the business failed to pay its monthly lease payments.

M.J. Zones was to make commercial lease payments for five years beginning Feb. 8, 2007, with a base annual rent of $38,400, being made payable in 12 equal monthly installments of $3,200, according to a complaint filed April 15 in Cabell Circuit Court.

Legend Properties, LLC, claims the defendant ceased making monthly installments in February 2010 and moved its business operations several blocks closer to Marshall University in order to be closer to customers.

The defendant is currently in default of the commercial lease and owes $34,900 in back rent as well as current and future rent through March 7, 2012, according to the suit.

Legend Properties claims that despite repeated demands, the defendant has refused to make its monthly commercial lease payments in breach of the commercial lease.

The defendant is obligated under the commercial lease to indemnify Legend Properties for all damages and expenses related to the breach, according to the suit.

Legend Properties is seeking monetary judgment for all unpaid past and future rent. It is being represented by John W. Alderman III.

The case has been assigned to Circuit Judge David M. Pancake.
