CHARLESTON -- A Charleston woman is suing Innovative Mattress Solutions after she claims she was injured when she fell on its sidewalk.
On Jan. 8, 2010, Pamela Toney was walking on the defendant's sidewalk when she slipped and fell on ice and snow, according to a complaint filed April 6 in Kanawha Circuit Court.
Toney claims the defendant had a duty to examine its premises for unsafe or dangerous conditions and correct them, but failed to do so,
The defendant's negligence caused Toney to become injured, according to the suit.
Toney is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Marvin W. Masters and Charles M. Love IV.
The case has been assigned to Circuit Judge James C. Stucky.
