CHARLESTON -- A man is suing the Metro Drug Unit after he claims it was supposed to return money that was taken from him.
On Dec. 30, 2010, members of the Metro Drug Unit seized $8,700 in U.S. currency from Mariel Garrett at Yeager Airport in Charleston, according to a complaint filed April 14 in Kanawha Circuit Court.
Garrett claims in accordance with West Virginia Code, a petition for forfeiture of property must be filed within 90 days of seizure and as the 90-day time period has expired, there is no factual or legal basis to hold his property.
The plaintiff and counsel have made several attempts to resolve the matter, according to the suit.
Garrett is seeking for the money to be returned to him within seven business days. He is being represented by William H. Harding.
The case has been assigned to Circuit Judge Charles E. King.
