CHARLESTON -- A Kentucky man is suing General Motors Corporation after he claims a vehicle he purchased was defective.
On Sept. 5, 2007, Donald Shomberg purchased a 2007 Chevrolet Silverado from C&O Motors in St. Albans for $31,951.02, according to a complaint filed April 22 in Kanawha Circuit Court.
Shomberg claims within a short time of his purchase, he noticed three prevalent and significant defects in the vehicle, including an air leak in the windshield, a light dimming problem and a brake light problem.
After Shomberg took the vehicle to three different General Motors Corporation dealerships, the problems were still not repaired, according to the suit.
Shomberg claims on March 15, 2010, he sent a certified "last change" letter to the defendant, notifying the company of the defects and affording General Motors an opportunity to repair the vehicle and conform it to its warranty, but General Motors did not repair the vehicle.
Shomberg is seeking compensatory damages. He is being represented by Timothy P. Rosinsky.
The case has been assigned to Circuit Judge Carrie Webster.
