CHARLESTON -- A Putcan County man is suing Alcan Rolled Products-Ravenswood, LLC, after he claims he was struck in the head by a pry bar while working.
Pioneer Pipe was also named as a defendant in the suit.
On May 11, 2009, Joseph L. Moore was performing his work duties when he was struck in the head by a pry bar that was approximately four feet long and weighed approximately eight pounds, according to a complaint filed April 13 in Kanawha Circuit Court.
Moore claims Pioneer Pipe performed the contract maintenance duties overhead without receiving permission from him or others working below prior to commencing work.
The existence of the unsafe working condition violated state and federal regulations, according to the suit.
Moore claims the defendants failed to properly barricade hazard areas and post warning signs below overhead work to be performed.
The defendants' negligence resulted in Moore's serious and permanent injuries, according to the suit.
Moore is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Anthony J. Majestro and C. Michael Bee.
The case has been assigned to Circuit Judge Charles E. King.
