Man sues HCR ManorCare for mother's death

CHARLESTON -- A man is suing HCR ManorCare after he claims the nursing home is responsible for his mother's death in 2009.

ManorCare, Inc.; HCR ManorCare West Virginia Properties, LLC; HCR ManorCare Services, Inc.; Heartland Employment Services, LLC; Heartland of Beckley WV, LLC; Health Care and Retirement Corporation of America, LLC; Jo Clair Hanshew; John Does 1 through 10; and Unidentified Entities 1 through 10 (as to Heartland of Beckley) were also named as defendants in the suit.

Dorothy Butler was a resident of the defendants from March 24, 2007, until May 2, 2009, according to a complaint filed April 29 in Kanawha Circuit Court.

James Butler, Dorothy Butler's son, claims his mother experienced infections, pneumonia, dehydration, malnutrition and ultimately, her death, because of the defendants' negligence.

The defendants failed to adequately care for Dorothy Butler, according to the suit.

James Butler claims his family entrusted his mother's care to the defendants, who failed to care for her.

James Butler is seeking compensatory and punitive damages. He is being represented by James B. McHugh, Michael J. Fuller Jr., Amy J. Quezon and D. Bryant Chaffin.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
