CHARLESTON – A woman and her husband are suing McDonald's Corporation and McDonald's Restaurants of West Virginia after she claims she was injured in a fall due to a slippery area in the floor.
On May 4, 2009, Kermelia R. Nesselrodt was a patron at the McDonald's restaurant in Belle and was in the women's restroom when she fell in a slippery area, according to a complaint filed May 2 in Kanawha Circuit Court.
Nesselrodt claims despite the condition of the wet floor the defendants failed to place any warnings or signs indicating that the floor area was slippery and/or wet.
The defendants also failed to check the condition of the bathroom with sufficient frequency to prevent accidents from occurring, according to the suit.
Nesselrodt claims she sustained injuries to her head, neck, back, shoulder, wrist, hips, knees, ankles and feet when she fell.
The defendants were negligent in failing to keep their premises in a reasonably safe and suitable manner, according to the suit.
Nesselrodt and her husband, Dorman Nesselrodt, are seeking compensatory damages. They are being represented by John Kennedy Bailey.
The case has been assigned to Circuit Judge Charles E. King.
