Woman sues over Consumer Credit and Protection Act violations

CHARLESTON -- A woman is suing Consumer Portfolio Services after she claims he repeatedly violated the West Virginia Consumer Credit and Protection Act.

Consumer Portfolio Services engaged in repeated violations of the West Virginia Consumer Credit and Protection Act by causing Elizabeth A. Blackburn's telephone to ring or engaging her in telephone conversations repeatedly and/or continuously and/or at unusual times and/or at times known to be inconvenient more than 300 times from May 10, 2010, until January 2011, according to a complaint filed May 5 in Kanawha Circuit Court.

Blackburn claims the defendant continued to contact her directly even after she referred them to her attorney.

The defendant's conduct was atrocious, intolerable and so extreme and outrageous as to exceed the bounds of decency, according to the suit.

Blackburn claims she has an expectation of privacy to be free from harassing, oppressing and annoying telephone calls within the confines of her home and the defendant's actions invaded and harmed her expectation of privacy.

Blackburn is seeking compensatory and punitive damages. She is being represented by Wesley Harrison White.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
