Man sues Teays Valley Center, Genesis for father's injuries

WINFIELD – A Putnam County man is suing Teays Valley Center and Genesis Healthcare Corporation after he claims his father was a victim of nursing home negligence.

Don E. Caldwell was a resident of the defendants from April 28, 2009, until May 6, 2009, according to a complaint filed June 7 in Putnam Circuit Court.

David Caldwell claims his father suffered serious injuries from a pattern of poor care, neglect and abuse rendered by the defendants and staff.

The defendants failed to provide adequate fluid intake and failed to take adequate measures to prevent Don E. Caldwell from suffering from dehydration during his residency, according to the suit.

David Caldwell claims the defendants also failed to keep the family fully informed of Don E. Caldwell's health status and medical condition.

The defendants failed to care for Don E. Caldwell in a manner and in such an environment free of accident hazards so as to promote the maintenance or enhancement of his quality of life, the complaint states.

David Caldwell is seeking compensatory and punitive damages. He is being represented by Andrew L. Paternostro and Jeff D. Stewart.

The case has been assigned to Circuit Judge Phillip Stowers.
