Boomer man sues 72 companies for lung cancer diagnosis

CHARLESTON -- A Boomer, W.Va., man is suing 72 companies after he claims they are responsible for his lung cancer.

On Feb. 14, Larry Macon McCommack was diagnosed with lung cancer, according to a complaint filed May 9 in Kanawha Circuit Court.

McCommack claims the defendants are responsible for his lung cancer because they caused him to be exposed to asbestos and/or asbestos-containing products.

The defendants failed to warn McCommack of the asbestos and/or asbestos-containing products' harmful nature, according to the suit.

McCommack claims he was exposed to the products from 1964 until 1995.

The defendants are being sued upon theories of negligence, contaminated buildings, breach of expressed/implied warranty, strict liability, intentional tort, conspiracy, misrepresentations and post-sale duty to warn, according to the suit.

McCommack is seeking a jury trial to resolve all issues involved. He is being represented by Victoria Antion and Bronwyn I. Rinehart.

The case has been assigned to a visiting judge.
