Huntington woman sues Interstate Management Co. for injuries

HUNTINGTON -- A Huntington woman is suing Interstate Management Co. after she claims she was injured at her apartment building.

Elizabeth Adkins was a tenant of the defendant leasing an apartment at the Adams Landing units.

On Dec. 29, 2009, Adkins was attempting to get to her car when she slipped on an unknown substance and fell violently to the ground, according to a complaint filed May 11 in Cabell Circuit Court.

Adkins claims the defendant had a duty to exercise ordinary care to maintain the premises in a reasonably safe condition and failed to do so.

The defendant failed to maintain the common walkways and parking area of the apartment complex in a reasonably safe condition; allowed a slippery substance to come into contact with and remain on the common walkways and parking lot of the apartment complex; and failed to warn Adkins of the danger it presented by the presence of the slippery substance, according to the suit.

Adkins claims the defendant failed to remove the leaves and ice from common walkways.

Interstate Management Co. was negligent in allowing Adkins to become injured by fracturing her left ankle and sustaining injuries to her left leg, back and neck, according to the suit.

Adkins is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Jon D. Hoover.

The case has been assigned to Circuit Judge David M. Pancake.
