CHARLESTON -- A Clendenin man is suing West Virginia-American Water after he claims it is responsible for property damages.
Sometime prior to July 14, 2010, a leak developed in a water line owned, operated and maintained by the defendant which runs across the front of property owned by Phillip E. Ross, according to a complaint filed May 11 in Kanawha Circuit Court.
Ross claims on July 14, 2010, a major slippage occurred on his property because of the water main leak.
The water main leak caused property damages to Ross' home and land, according to the suit.
Ross claims the property damage was so extensive that it was unsafe to bring heavy equipment onto the property to attempt to fix the damage.
The defendant failed to maintain the water line, according to the suit.
Ross is seeking compensatory damages with pre- and post-judgment interest. He is being represented by Marvin W. Masters and Christopher L. Brinkley.
The case has been assigned to Circuit Judge Tod J. Kaufman.
