CHARLESTON -- A former inmate is suing the West Virginia Division of Corrections after he claims he was injured while working at the St. Marys Correctional Center.
On April 9, 2010, Luther Marcum was an inmate at the correctional center in Pleansants County and was assigned to operate a grinding machine, according to a complaint filed May 16 in Kanawha Circuit Court.
Marcum claims while operating the machine, a guard on the grinder gave way, which resulted in his finger becoming partially severed.
The defendant failed to properly maintain the grinder and failed to provide Marcum with the proper safety equipment, according to the suit.
Marcum is seeking compensatory damages. He is being represented by Larry O. Ford.
The case has been assigned to Circuit Judge Tod J. Kaufman.
