Nitro woman sues water company for injuries

CHARLESTON -- A Nitro woman is suing West Virginia-American Water Company after she stepped into a grass-covered water meter hole that did not have a lid.

On Aug. 14, 2010, Elizabeth Moore exited a vehicle in which she was traveling as a passenger with the intent of visiting a yard sale on Washington Avenue, according to a complaint filed May 25 in Kanawha Circuit Court.

Moore claims upon exiting the vehicle, she walked to a gravel and grassy area between the street and the yard and stepped into a grass-covered water meter hole with no lid and was injured.

The defendant failed to keep the street, walkways and public grounds in and around the area in repair and free from nuisance and hidden dangers, according to the suit.

Moore claims the defendant failed to keep the water meter lid in a closed and/or locked position, which caused to her be injured.

Moore is seeking compensatory damages. She is being represented by J. Michael Ranson and Cynthia M. Ranson.

The case has been assigned to Circuit Judge Paul Zakaib Jr.
