CHARLESTON -- A woman is suing her former dentist after she claims he was negligent in performing a root canal.
On March 25, 2009, Dr. Phillip Majestro performed a root canal on Amanda Clay's lower right first molar, according to a complaint filed May 31 in Kanawha Circuit Court.
Clay claims during the procedure, a file was separated in the tooth and Majestro negligently and in violation of the standard of care failed to attempt to retrieve the file.
Majestro also failed to refer Clay to a specialist for further treatment for retrieval of the file, according to the suit.
Clay claims in failing to retrieve or treat the separated file in the tooth caused her to develop an abscess, which ultimately resulted in her losing the tooth, requiring an implant and crown placement.
The defendant's negligent caused Clay great pain in body and mind and incur medical expenses, according to the suit.
Clay is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Douglas Witten, Donald C. Wandling and David Wandling.
The case has been assigned to Circuit Judge Jennifer Bailey.
