Former inmate sues jail authority, others for injuries

CHARLESTON -- A former South Central Regional Jail inmate is suing the West Virginia Regional Jail Authority after she claims she was injured during her incarceration.

Jennifer Windland was injured while incarcerated in South Central Regional Jail by John McKay, a correctional officer, and John Doe, an unknown person, according to a complaint filed June 1 in Kanawha Circuit Court.

Windland claims McKay and Doe "visited extreme cruel and unusual punishment" upon her.

The jail authority knew or should have known that placement of Windland in the South Central Regional Jail laundry facility exposed her to a substantial risk of serious injury, such as amputation of a limb.

Windland claims the jail authority knew or should have known that McKay and Doe failed to comply with the law and standards required of a staff member of their position.

On Sept. 28, 2010, Windland was opening a laundry dryer when she had approximately one-third of her left arm violently ripped off, according to the suit.

Windland claims she was not trained to use the dryer and the defendants did not supervise her.

The defendants failed to keep the facility in a safe, working order, according to the suit.

Windland is seeking compensatory and punitive damages. She is being represented by Kerry A. Nessel.

The case has been assigned to Circuit Judge Tod J. Kaufman.
