Woman says BW3 sold alcohol to underage son, led to his death

HUNTINGTON -- A woman is suing Buffalo Wild Wings after she claims the restaurant knowingly sold alcohol to her underage son, which attributed to his death.

On June 3, 2009, Shawn Carver left his place of work and went to Buffalo Wild Wings, where he purchased beer with a credit card, which would have required identification and proof of age, according to a complaint filed June 2 in Cabell Circuit Court.

Mary Carver, Shawn Carver's mother, claims her son wrecked his vehicle at approximately 1 a.m. on June 4, 2009, when he lost control of the vehicle and ran off the roadway.

Shawn Carver was projected from the vehicle through the passenger window and was transported to Cabell Huntington Hospital by EMS after being extracted by the Fire Department, according to the suit.

Mary Carver claims the defendant contributed to her son's death by violating regulations and rules by selling beer to him knowing that he was underage.

Mary Carver is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Michael E. Froble.

The case has been assigned to Circuit Judge David M. Pancake.
