HUNTINGTON -- A woman is suing Chateau Grove, Inc., after she claims an employee exposed himself to her family member.
Chateau Grove, Inc., is doing business as Chateau Grove Senior Living.
M.B., 81, suffers from Alzheimer's disease and was a resident of Chateau Grove, according to a complaint filed June 3 in Cabell Circuit Court.
On Jan. 30, 2010, D.B. claims Darren Canada, an employee, was caught by another staff member with his pants to his knees, exposing himself to M.B.
M.B. was lying in her bed in her room when the incident occurred, acording to the suit.
D.B. claims Chateau Grove has a policy that requires two workers to be president in a resident's room, but Canada had been found alone in M.B.'s room.
After the incident, M.B. was taken to Cabell Huntington Hospital for treatment and Canada was charged with first degree sexual abuse and abuse and neglect by a caregiver on an incapacitated adult, according to the suit.
D.B. claims Canada had a previous criminal history of carrying a concealed weapon without a license, burglary, fugitive from justice in Arkansas and possession of a deadly weapon, yet Chateau Grove still hired him.
Chateau Grove had a duty to report the incident to the West Virginia Department of Health and Human Resources, and has been cited by the WVDHHR for failing to conduct background checks on employees, according to the suit.
D.B. is seeking compensatory and punitive damages with pre- and post-judgment interest. Kathy A. Brown is representing the plaintiff.
The case has been assigned to Circuit Judge F. Jane Hustead.
