CHARLESTON -- A Cross Lanes couple is suing Freedom Homes after they claim their property was damaged because of water runoff.
During later 2007 and early 2008, Freedom Homes cleared trees and placed a double-wide mobile home on property in Cross Lanes that sits above property owned by Shawn and Doreen Colbert, according to a complaint filed June 6 in Kanawha Circuit Court.
The Colberts claim in late 2008 as a result of the clearing of the property owned by Freedom Homes, their property began to be inundated with water runoff, which caused damage to their lawn.
Despite requests to do so, the defendant took no action to stop the water from running onto the Colberts' property, according to the suit.
The Colberts claim beginning in late 2009, their property began receiving large amounts of water runoff that damaged their property and their residence, and in 2010, their basement began having leaks, the foundation and structure of the home was damaged and the yard was damaged.
The defendant has failed to fix the problems, according to the suit.
The Colberts claim as a result of the clearing on the property owned by the defendant, their property began to be inundated with water runoff from the defendants' property, which caused damage.
The Colberts are seeking compensatory damages with pre- and post-judgment interest. They are being represented by Kevin M. Baker and Michael L. Glasser.
The case has been assigned to Circuit Judge Tod J. Kaufman.
