CHARLESTON -- A South Charleston couple is suing West Virginia-American Water Company after their property was damaged because of a main water line leak.
In July 2010, the defendant's main water line running along Hollyberry Lane broke and began leaking, according to a complaint filed June 8 in Kanawha Circuit Court.
Richard J. Naseef and Wilma Naseef claim that as a result of the water leaking, it seeped down against and around their residence, which resulted in structural damage to their residence.
The Naseef residence also sustained cracks in the bricks near the garage doors and the cement driveway raising up, according to the suit.
The couple claims the defendant had a duty to operate its water distribution system in a reasonably prudent manner.
West Virginia-American Water Company breached its duty by failing to maintain the distribution system and was negligent, according to the suit.
The Naseefs also claim they are entitled to damages for repairs to their residence; repairs to the driveway; diminution in the value of the residence; and annoyance and inconvenience.
The Naseefs are seeking are seeking compensatory damages. They are being represented by Michael J. Del Giudice.
The case has been assigned to Circuit Judge Tod J. Kaufman.
