Hurricane woman sues Go-Mart for injuries

CHARLESTON -- A Hurricane woman is suing Go-Mart after she was injured at its St. Albans store.

On June 4, 2009, Lou Ann Nelson was at the St. Albans G-Mart and was shopping for convenience items when she slipped on water, dirt, mud and some other substance and fell, according to a complaint filed June 2 in Kanawha Circuit Court.

Nelson claims as a result of the customer area not being properly maintained, she sustained severe injury to her left knee, which ultimately resulted in a total knee replacement.

The defendant owed a duty to patrons to prevent and lookout for unsafe or potentially unsafe condition and further owed a duty to maintain the customer service area in a reasonably safe condition, according to the suit.

Nelson claims Go-Mart was negligent and careless in maintaining its store.

Nelson is seeking compensatory damages with pre- and post-judgment interest. She is being represented by Joseph K. Reeder.

The case has been assigned to Circuit Judge Carrie Webster.
