Woman says Harbor Freight fired her because of disability

CHARLESTON -- A former Harbor Freight Tools USA employee says she was discriminated against because of her disability.

Steven Stuart, another employee of Harbor Freight Tools USA, was also named as a defendant in the suit.

Kimberly Sutton was employed by the defendants from March 8, 2010, until July 19, 2010, according to a complaint filed June 6 in Kanawha Circuit Court.

Sutton claims her employment was terminated because of her disability, which is in violation of the West Virginia Human Rights Act.

As a result of the defendants' actions, Sutton suffered economic loss, according to the suit.

Sutton claims Stuart either made the final decision or recommended her termination.

Sutton is seeking reinstatement and compensatory and punitive damages. She is being represented by J. Michael Ranson, Cynthia M. Ranson and George B. Morrone.

The case has been assigned to Circuit Judge James C. Stucky.
