CHARLESTON -- A former branch manager of First Bank of Charleston is suing after she claims her employment was wrongful terminated.
Percy Osborne, Randall Coleman and Anthony Marks, three employees from First Bank of Charleston, were also named as defendants in the suit.
In June 2008, the defendants began to subject Fayola Bailey to discrimination based upon her age, according to a complaint filed June 21 in Kanawha Circuit Court.
Bailey claims after June 2008, the offices of First Bank of Charleston began stirring with rumors that her direct supervisor was engaged in an extramarital affair with a female employee and an anonymous phone call was made to the supervisor's wife about the affair.
The defendants accused Bailey of making the phone call and made changes to her employment responsibilities, according to the suit.
Bailey claims the defendants used intimidation tactics to threaten her employment and fabricated reasons to justify reprimands against her in order to justify a subsequent termination of her employment.
On June 26, 2009, the defendants wrongfully terminated Bailey's employment, according to the suit.
Bailey claims the defendants' actions were willful, wanton and/or undertaken with reckless disregard and/or reckless indifference to her rights.
The defendants also violated the West Virginia Human Rights Act and caused Bailey to suffer loss of income, according to the suit.
Bailey is seeking compensatory and punitive damages with pre- and post-judgment interest. She is being represented by Michael A. Olivio and Travis A. Griffith.
The case has been assigned to Circuit Judge Paul Zakaib Jr.
