CHARLESTON -- A former employee is suing Mobile Now after he claims he did not receive his final wages within 72 hours.
Daniel Ballengee was employed by the defendant from December 2010 until his discharge on May 27, according to a complaint filed June 21 in Kanawha Circuit Court.
Ballengee claims the defendant failed to pay his final employment wages until June 1, which was not within 72 hours of his discharge.
The defendant's actions violated the West Virginia Wage Payment and Collection Act, according to the suit.
Ballengee is seeking compensatory and punitive damages with pre- and post-judgment interest. He is being represented by Todd S. Bailess and Joy B. Mega.
The case has been assigned to Circuit Judge Carrie Webster.
