White Dodge Inc. also was named as a defendant in the suit.
On Aug. 17, 2009, Joseph and Gretchen Pingley purchased a 2009 Dodge Durango Hybrid from the defendants, according to a complaint filed June 10 in Kanawha Circuit Court.
The Pingleys claim after purchasing the vehicle they discovered repeated non-conformities that impaired the use of the vehicle.
The vehicle began stalling while driving, which created a condition likely to result in death or serious injury if the vehicle was driven, according to the suit.
The Pingleys claim they requested repairs, but the defendants did not have the ability to repair the vehicle, so they arranged for the vehicle to be taken to an out-of-state facility for repairs.
The out-of-state facility then failed and refused to repair the vehicle and failed or refused to provide a comparable replacement vehicle and to reimburse the Pingleys, according to the suit.
The Pingleys are seeking compensatory and punitive damages with pre- and post-judgment interest. They are being represented by Cameron S. McKinney and David L. Grubb.
The case has been assigned to Circuit Judge Louis Bloom.
