* Mayle claims he was terminated from his employment as a heavy equipment operator after he filed a workers' comp claim. Mayle suffered a twisted ankle and back injury after being pushed by another employee. After seeking medical attention, he informed his employer he would be unable to return to work due to his injuries. He was initially approved for workers' comp and sought further medical treatment that included an MRI to determine the extent of his back injury. During this time, he was unable to report to work. He was notified, by mail, that the company decided he willfully abandoned his employment because he had not submitted an application for medical leave under the Family and Medical Leave Act. After Mayle recovered from his injuries, he asked if he could be reinstated and was denied. Mayle seeks punitive and compensatory damages and lost wages.
